Offense of Conducting Activities Aimed at Overthrowing the People’s Government

Article 109 of the 2015 Criminal Code provides for the offense of conducting activities aimed at overthrowing the people’s government as follows:

Any person who carries out activities to establish or participates in an organization with the purpose of overthrowing the people’s government shall be subject to the following penalties:

1. The organizer, instigator, active participant, or any person causing serious consequences shall be liable to a prison term of 12 to 20 years, or life imprisonment;

2. Other accomplices shall be liable to a prison term of 5 to 12 years;

3. Any person preparing to commit this offense shall be liable to a prison term of 1 to 5 years.
