Failure to Rescue a Person in Life-Threatening Danger

1. Any person who sees another person in a life-threatening situation but, despite having the ability to rescue, fails to do so, resulting in that person’s death, shall be subject to a warning, non-custodial reform for up to 02 years, or imprisonment from 03 months to 02 years.

2. The offense shall be punishable by 01 to 05 years’ imprisonment if committed under any of the following circumstances:

a) The person who failed to rescue is the one who negligently caused the dangerous situation;

b) The person who failed to rescue is a person who, by law or by virtue of their profession, is under an obligation to provide rescue.

3. If the offense results in the death of two or more persons, the offender shall be subject to 03 to 07 years’ imprisonment.

4. The offender may also be prohibited from holding certain positions, practicing certain professions, or performing certain jobs for 01 to 05 years.
