Participants in Criminal Proceedings

The Criminal Procedure Code provides for participants in legal proceedings as follows:

  1. Persons who denounce crimes, report crimes, or petition for prosecution.

  2. Persons who are denounced or persons against whom a petition for prosecution is made.

  3. Persons held in urgent circumstances.

  4. Arrested persons.

  5. Persons held in custody.

  6. Suspects (Bị can).

  7. Defendants (Bị cáo).

  8. Victims.

  9. Civil plaintiffs.

  10. Civil defendants.

  11. Persons with related rights and obligations in the case.

  12. Witnesses.

  13. Persons witnessing procedural acts.

  14. Assessors (expert witnesses).

  15. Valuation experts.

  16. Interpreters and translators.

  17. Defense counsels.

  18. Representatives protecting the lawful rights and interests of victims and litigants.

  19. Representatives protecting the lawful rights and interests of persons who are denounced or persons against whom a petition for prosecution is made.

  20. Legal representatives of criminally charged juridical persons and other representatives as provided in this Code.
