Crime of Murder under the 2015 Criminal Code

1. Any person who commits murder under one of the following circumstances shall be sentenced to imprisonment for 12 to 20 years, life imprisonment, or the death penalty:

a) Murder of two or more persons;
b) Murder of a person under 16 years of age;
c) Murder of a woman known to be pregnant;
d) Murder of a person performing official duties or because of the victim’s official duties;
đ) Murder of one’s grandparents, parents, foster parents, or teachers;
e) Murder committed immediately before or after the commission of another very serious or especially serious crime;
g) Murder for the purpose of committing or concealing another crime;
h) Murder to obtain parts of the victim’s body;
i) Murder committed in a barbaric manner;
k) Murder committed by abusing one’s profession;
l) Murder committed by methods capable of killing multiple people;
m) Murder-for-hire or contract killing;
n) Murder with a hooligan-like nature;
o) Murder committed in an organized manner;
p) Murder committed by a dangerous recidivist;
q) Murder committed due to despicable motives.

2. A person who commits murder not falling under the circumstances specified in Clause 1 of this Article shall be sentenced to imprisonment for 07 to 15 years.

3. A person who prepares to commit this crime shall be sentenced to imprisonment for 01 to 05 years.

4. The offender may also be subject to a ban from practicing certain professions or performing certain jobs for 01 to 05 years, probation, or banishment from residence for 01 to 05 years.
