
Offense of Violating Construction Regulations Causing Serious Consequences
1. Any person who violates construction regulations in the fields of surveying, design, construction, use of raw materials, materials, machinery, supervision, acceptance testing, or other related fields, and falls under one of the following circumstances, if not falling under Article 224 or Article 281 of the 2015 Criminal Code, shall be subject to a fine of between VND 50,000,000 and 500,000,000, non-custodial reform for up to 03 years, or imprisonment from 01 year to 05 years:
a) Causing the death of a person;
b) Inflicting bodily harm or injury on another person with a bodily harm rate of 61% or more;
c) Inflicting bodily harm or injury on 02 or more persons with a total bodily harm rate ranging from 61% to 121%;
d) Causing property damage valued from VND 100,000,000 to under VND 500,000,000.
2. If the offense falls under one of the following circumstances, the offender shall be subject to imprisonment from 03 years to 10 years:
a) Causing the death of 02 persons;
b) Inflicting bodily harm or injury on 02 or more persons with a total bodily harm rate ranging from 122% to 200%;
c) Causing property damage valued from VND 500,000,000 to under VND 1,500,000,000.
3. If the offense falls under one of the following circumstances, the offender shall be subject to imprisonment from 07 years to 15 years:
a) Causing the death of 03 or more persons;
b) Inflicting bodily harm or injury on 03 or more persons with a total bodily harm rate of 201% or more;
c) Causing property damage valued at VND 1,500,000,000 or more.
4. The offender may also be subject to a fine of between VND 30,000,000 and 100,000,000, prohibition from holding certain positions, practicing certain professions, or performing certain jobs for a term of 01 year to 05 years.
