Crime of Illicit Use of Narcotic Substances
1. Any person who illicitly uses narcotic substances in any of the following cases shall be sentenced to 02 to 03 years’ imprisonment:
a) While undergoing compulsory drug detoxification or treatment for drug addiction with substitute medications as prescribed by the Law on Drug Prevention and Control;
b) While being under post-detoxification management as prescribed by the Law on Drug Prevention and Control;
c) Within 02 years from the date the period of post-detoxification management expires, and while being subject to management as an illicit drug user under the Law on Drug Prevention and Control;
d) Within 02 years from the date of voluntarily terminating drug detoxification or treatment for drug addiction with substitute medications as prescribed by the Law on Drug Prevention and Control.
2. A repeat offender of this crime shall be sentenced to 03 to 05 years’ imprisonment.
