Acts Prohibited in the Management and Use of Weapons, Explosives, Explosive Precursors, and Supporting Tools

  1. Individuals are prohibited from possessing weapons, explosives, or supporting tools, except for weapons specified in Point a, Clause 4, Article 2 of this Law that are displayed as exhibits or kept as antiques.
    (Rudimentary weapons include: swords, spears, halberds, daggers, bayonets, machetes, clubs, maces, bows, crossbows, throwing knives listed in the catalogue issued by the Minister of Public Security.)

  2. Researching, manufacturing, producing, trading, exporting, importing, storing, transporting, repairing, modifying, using illegally, or appropriating military weapons, sporting weapons, rudimentary weapons, explosives, explosive precursors, or supporting tools.

  3. Researching, manufacturing, producing, trading, exporting, importing, storing, transporting, repairing, modifying, using, or appropriating hunting firearms.

  4. Illegally transporting or carrying weapons, explosives, explosive precursors, or supporting tools into or out of the territory of the Socialist Republic of Vietnam, or into prohibited areas, protected zones, protection targets, or public places.

  5. Exploiting or abusing the management and use of weapons, explosives, explosive precursors, or supporting tools to infringe upon national security, social order and safety, human life and health, property, or lawful rights and interests of agencies, organizations, or individuals.

  6. Exploiting or abusing the performance of duties in preventing and combating violations related to weapons, explosives, or supporting tools to extort, infringe on state interests, infringe upon lawful rights and interests, or obstruct normal activities of organizations or individuals.

  7. Destroying or deliberately damaging weapons, explosives, explosive precursors, or supporting tools that have been assigned.

  8. Delivering weapons, explosives, explosive precursors, or supporting tools to agencies, organizations, enterprises, or individuals that do not meet the legal conditions.

  9. Exchanging, gifting, giving, receiving, providing aid, sending, borrowing, lending, renting, leasing, or pawning weapons, explosives, explosive precursors, or supporting tools, except in the following cases:
    a) Foreign organizations, enterprises, or individuals gifting, giving, or providing aid of weapons or supporting tools to domestic agencies, organizations, or enterprises for research, manufacture, production, equipment, use, or exhibition purposes in accordance with this Law;
    b) Exchanging, gifting, giving, receiving, sending, borrowing, lending, renting, or leasing rudimentary weapons as exhibits or antiques;
    c) Authorized by competent authorities.

  10. Transporting, storing, or destroying weapons, explosives, explosive precursors, or supporting tools in a manner that is unsafe or harmful to the environment.

  11. Appropriating, trading, exchanging, gifting, lending, renting, pawning, forging, repairing, or altering permits, certificates, or licenses related to weapons, explosives, explosive precursors, or supporting tools.

  12. Appropriating, trading, exchanging, gifting, sending, lending, renting, or pawning scrap or discarded materials of weapons, explosives, or supporting tools illegally.

  13. Illegally guiding, training, or organizing training on how to manufacture, produce, repair, use weapons, explosives, explosive precursors, or supporting tools, or advertising such items in any form.

  14. Concealing, failing to report, or assisting others in manufacturing, producing, trading, exporting, importing, storing, transporting, repairing, modifying, illegally using, or destroying weapons, explosives, explosive precursors, or supporting tools.

  15. Illegally searching for or collecting weapons, explosives, supporting tools, or scrap and discarded materials of weapons, explosives, or supporting tools.

  16. Intentionally providing false information regarding the management of weapons, explosives, explosive precursors, or supporting tools; failing to report, concealing, or falsifying reports regarding loss, theft, accidents, or incidents involving weapons, explosives, explosive precursors, or supporting tools.
