Offense of Organizing the Illegal Use of Narcotic Substances
Article 255 of the 2015 Criminal Code provides for the offense of organizing the illegal use of narcotic substances as follows:
1. Any person who organizes the illegal use of narcotic substances in any form shall be liable to a prison term of 3 to 7 years.
2. The offender shall be liable to a prison term of 7 to 15 years if the offense falls under one of the following circumstances:
a) The offense is committed two or more times;
b) The offense involves two or more persons;
c) The offense is committed against a person aged from 13 to under 18 years;
d) The offense is committed against a woman known to be pregnant;
đ) The offense is committed against a person undergoing drug rehabilitation;
e) The act causes bodily harm to another person with a bodily injury ratio from 31% to 60%;
g) The act transmits a dangerous disease to another person;
h) The offender commits dangerous recidivism.
3. The offender shall be liable to a prison term of 15 to 20 years if the offense falls under one of the following circumstances:
a) The act causes bodily harm to another person with a bodily injury ratio of 61% or more, or results in death;
b) The act causes bodily harm to two or more persons, each having a bodily injury ratio from 31% to 60%;
c) The act transmits a dangerous disease to two or more persons;
d) The offense is committed against a person under 13 years old.
4. The offender shall be liable to 20 years’ imprisonment or life imprisonment if:
a) The act causes bodily harm to two or more persons, each with a bodily injury ratio of 61% or more;
b) The act causes the death of two or more persons.
5. The offender may also be subject to a fine of VND 50,000,000 to VND 500,000,000, probation, prohibition from residence for 1 to 5 years, or confiscation of part or all of their property.
