Destroying or Deliberately Damaging Property

1. Any person who destroys or deliberately damages another person’s property valued at from VND 2,000,000 to under VND 50,000,000, or property valued at under VND 2,000,000 but falling under one of the following circumstances, shall be subject to a fine from VND 10,000,000 to VND 50,000,000, non-custodial reform for up to 03 years, or imprisonment from 06 months to 03 years:

a) The offender has already been administratively sanctioned for one of the acts prescribed in this Article but continues to commit the violation;

b) The offender has already been convicted of this offense, has not had the criminal record expunged, and continues to commit the violation;

c) The act adversely affects national security, social order, or public safety;

d) The damaged property is the primary means of livelihood of the victim and their family;

đ) The property is a relic or an antique.

2. The offense shall be punishable by 02 to 07 years’ imprisonment if committed under any of the following circumstances:

a) Committed in an organized manner;

b) Causing property damage valued at from VND 50,000,000 to under VND 200,000,000;

c) The property is a national treasure;

d) Using fire, explosives, or other dangerous methods;

đ) Committed for the purpose of concealing another offense;

e) Committed due to the victim’s official duties;

g) Dangerous recidivism.

3. If the offense causes property damage valued at from VND 200,000,000 to under VND 500,000,000, the offender shall be liable to 05 to 10 years’ imprisonment.

4. If the offense causes property damage valued at VND 500,000,000 or more, the offender shall be liable to 10 to 20 years’ imprisonment.

5. The offender may also be subject to a fine from VND 10,000,000 to VND 100,000,000, and/or prohibition from holding certain positions, practicing certain professions, or performing certain jobs for 01 to 05 years.
