
Circumstances in Which Failure to Report a Crime Does Not Constitute Criminal Liability
- A person who fails to report a crime shall not bear criminal liability if he or she is the offender’s grandfather, grandmother, father, mother, child, grandchild, sibling, or spouse, except in cases of failure to report crimes infringing upon national security or other crimes classified as particularly serious.
- A defense counsel who fails to report a crime shall not bear criminal liability, except in cases of failure to report crimes infringing upon national security or other crimes classified as particularly serious that are being prepared, committed, or have been committed by the very person whom he or she is defending, and of which the defense counsel is aware in the course of providing legal defense.
