Prohibited Acts in Construction

  • Making investment decisions in construction contrary to the provisions of the Law on Construction.

  • Commencing construction works without satisfying the conditions for commencement as prescribed by the Law on Construction.

  • Constructing works in areas where construction is prohibited; constructing works encroaching upon protection corridors of national defense and security works, transport, irrigation, dikes, energy facilities, historical – cultural relics, and other protected works as prescribed by law; constructing works in areas already warned of risks of landslides, flash floods, or debris flows, except for works built to remedy such phenomena.

  • Constructing works not in accordance with construction planning, except where a temporary construction permit has been issued; violating construction boundary lines or elevation lines; constructing works inconsistent with the granted construction permit.

  • Preparing, appraising, and approving designs and cost estimates of construction works funded by public investment capital or state capital outside public investment in contravention of the Law on Construction.

  • Contractors participating in construction activities without satisfying capacity conditions to perform such activities.

  • Project owners selecting contractors that do not meet capacity conditions to perform construction activities.

  • Constructing works not in compliance with the technical standards and regulations selected for application to the works.

  • Producing or using construction materials harmful to public health and the environment.

  • Violating regulations on occupational safety, property safety, fire prevention and fighting, security, order, and environmental protection in construction.

  • Using works for purposes inconsistent with their approved functions; illegally expanding, encroaching upon the lawful managed and used areas, space of other organizations or individuals, and public/common areas.

  • Giving or receiving bribes in construction investment activities; abusing the legal status of another entity to participate in construction activities; colluding or manipulating to falsify project preparation, surveys, designs, or construction supervision results.

  • Abusing positions or powers to violate construction laws; covering up or delaying the handling of violations of construction laws.

  • Obstructing lawful construction investment activities.
