Cases of Failure to Denounce Crimes Without Bearing Criminal Liability

  • A person who fails to denounce a crime committed by his/her grandparents, parents, children, grandchildren, biological siblings, spouse shall not bear criminal liability, except in cases of failure to denounce crimes infringing upon national security or other crimes categorized as particularly serious crimes.

  • A defense counsel who fails to denounce a crime shall not bear criminal liability, except in cases of failure to denounce crimes infringing upon national security or other crimes categorized as particularly serious crimes, which are being prepared, committed, or have been committed by the person he/she is defending, and which the defense counsel clearly knows during the course of defense.
