Complaint Dossier in Competition Cases and Procedures for Reviewing the Dossier

Competition Complaints

  1. Organizations and individuals who believe that their lawful rights and interests have been infringed upon due to acts violating competition law have the right to file a competition complaint with the National Competition Commission.

  2. The statute of limitations for filing a complaint is three (03) years from the date the act showing signs of violating competition law was committed.

  3. A complaint dossier shall include:
    a) A complaint form in the format issued by the National Competition Commission;
    b) Evidence proving that the contents of the complaint are well-founded and lawful;
    c) Other information and evidence deemed necessary by the complainant for resolving the case.

  4. The complainant shall be responsible for the truthfulness of the information and evidence provided to the National Competition Commission.


Receipt and Review of Complaint Dossiers

  1. Within seven (07) working days from the date of receipt of the complaint dossier, the National Competition Commission shall review the completeness and validity of the dossier. If the complaint dossier is complete and valid, the National Competition Commission shall notify the complainant of the acceptance of the dossier and at the same time notify the respondent.

  2. Within fifteen (15) days from the date of issuing the notification to the relevant parties as prescribed in Clause 1 above, the National Competition Commission shall review the complaint dossier. If the dossier fails to meet the requirements specified in Clause 3, Article 77 of the Law on Competition, the National Competition Commission shall issue a written notice requesting the complainant to supplement the dossier.

The time limit for supplementing the complaint dossier shall not exceed thirty (30) days from the date of receipt of the request for supplementation. The National Competition Commission may extend the time for supplementation once, for no more than fifteen (15) days, at the request of the complainant.

  1. During the time limits specified in Clauses 1 and 2 above, the complainant has the right to withdraw the complaint dossier, and the National Competition Commission shall cease reviewing the complaint dossier.
