Responsibilities of Procedural Authorities and Procedural Officers
(Article 13, Civil Procedure Code 2015)

1. Procedural authorities and procedural officers must show respect for the People and be subject to the People’s supervision.

2. The Court has the duty to protect justice, protect human rights and citizens’ rights, protect the socialist regime, protect the interests of the State, and protect the lawful rights and interests of organizations and individuals.

The People’s Procuracy has the duty to protect the law, protect human rights and citizens’ rights, protect the socialist regime, protect the interests of the State, and protect the lawful rights and interests of organizations and individuals, thereby contributing to ensuring that the law is strictly and uniformly observed.

3. Procedural authorities and procedural officers must keep state secrets and professional secrets as prescribed by law; preserve the fine customs and traditions of the nation; protect minors; and keep professional, business, personal, and family secrets of the litigants at their legitimate request.

4. Procedural authorities and procedural officers are legally responsible for the performance of their duties and powers. If a procedural officer commits an unlawful act, depending on the nature and seriousness of the violation, they shall be subject to disciplinary action or criminal prosecution in accordance with law.

5. If, in the performance of their duties and powers, a procedural officer commits an unlawful act causing damage to an agency, organization, or individual, the agency directly managing the officer who committed the unlawful act must compensate the injured party in accordance with the law on State compensation liability.
