According to Article 142 Law on Housing 2023 – Private Ownership and Common Ownership in Condominiums

Private ownership in a condominium includes:
a) The floor area inside the apartment, including balconies and loggias attached to such apartment;
b) Other areas in the condominium recognized as privately owned by the condominium owner;
c) Systems and equipment used exclusively and attached to the apartment or to other areas under the private ownership of the condominium owner, except for equipment under common ownership as prescribed in Clause 2 of this Article. -
Common ownership in a condominium includes:
a) The remaining floor area of the condominium other than the areas under private ownership as prescribed in Clause 1 of this Article; the condominium’s community room;
b) The space and structural system bearing loads, and equipment for common use in the condominium, including: frames, columns, load-bearing walls, exterior walls of the building, partition walls between apartments, floors, roofs, terraces, corridors, staircases, elevators, emergency exits, garbage shafts, technical boxes and their enclosing walls (if any), power supply system, water supply system, gas supply system, communication system, broadcasting, television, drainage, septic tanks, lightning protection, fire prevention and fighting system, and other parts not under private ownership of condominium owners;
c) Technical infrastructure systems outside the condominium but connected to it, except for infrastructure systems used for public purposes or those required to be handed over to the State or to the housing project developer for management in accordance with the approved project;
d) Public works within the condominium area that are not invested in for business purposes or not required to be handed over to the State under the approved project, including common yards, gardens, parks, and other facilities as specified in the approved project. -
The privately owned and commonly owned areas and equipment specified in this Article must be clearly stated in the purchase contract, lease-purchase contract of apartments, or other areas within the condominium. If such contracts do not specify them, private ownership and common ownership shall be determined in accordance with the provisions of this Article.
