Violations of Investment and Business Conditions in Conditional Business Sectors
1. A fine of VND 3,000,000 to VND 5,000,000 shall be imposed for any of the following violations:
a) Adding, erasing, or altering information in a business license;
b) Leasing, lending, mortgaging, pledging, selling, or transferring a business license;
c) Renting, borrowing, receiving as collateral, mortgaging, buying, or receiving transfer of a business license.
2. A fine of VND 5,000,000 to VND 10,000,000 shall be imposed for conducting business outside the scope, object, scale, duration, location, area, or items stated in the issued business license.
3. A fine of VND 10,000,000 to VND 15,000,000 shall be imposed for any of the following violations:
a) Conducting business in goods or services in conditional business sectors without a valid business license;
b) Conducting business in goods or services in conditional business sectors with an expired business license;
c) Conducting business in goods or services in conditional business sectors without meeting the prescribed investment and business conditions during operations;
d) Using another trader’s business license to conduct business.
4. A fine of VND 15,000,000 to VND 20,000,000 shall be imposed for continuing business operations during the period when a competent state management agency suspends operations, revokes, or withdraws the business license.
5. Double the fines prescribed in Clauses 1 to 4 shall apply to subjects engaged in industrial alcohol production; processing or trading tobacco materials; manufacturing tobacco products; or distributing and wholesaling alcohol or tobacco products when committing administrative violations.

7. Remedial measures:
a) Return the business license that has been erased, altered, or modified to the competent authority that issued it for violations under point a, Clause 1;
b) Return any illegal profits obtained from violations under points b, Clauses 1, 2, 3, and 4.
