Prohibited acts prescribed in the Law on Road Traffic of Vietnam

Article 8 of the Law on Road Traffic 2008 stipulates Prohibited Acts as follows:

  1. Destroying roads, bridges, tunnels, road ferries, traffic lights, traffic posts, traffic signs, convex mirrors, median strips, drainage systems, and other facilities and equipment belonging to the road traffic infrastructure.

  2. Illegally digging, drilling, or cutting roads; illegally placing or leaving obstacles on roads; placing or spreading sharp objects, pouring slippery substances on roads; illegally leaving materials, waste, or garbage on roads; illegally opening or connecting roads to main roads; encroaching upon or illegally using road land or road safety corridors; arbitrarily opening manhole covers, dismantling, illegally relocating, or altering road facilities.

  3. Illegally using roadways, roadsides, or pavements.

  4. Operating motor vehicles or specialized vehicles that fail to meet technical safety and environmental protection standards in road traffic.

  5. Altering vehicle assemblies, components, or accessories of motor vehicles to temporarily meet technical standards during inspection.

  6. Organizing, participating in, or cheering for illegal racing; performing dangerous swerving or zigzag driving maneuvers.

  7. Operating road vehicles under the influence of narcotic substances.

  8. Operating road vehicles with a blood alcohol concentration or breath alcohol concentration.

    Operating motorcycles or mopeds with a blood alcohol concentration exceeding 50 milligrams per 100 milliliters of blood or 0.25 milligrams per 1 liter of breath.

  9. Operating motor vehicles without a driver’s license as prescribed.

    Operating specialized vehicles in road traffic without a certificate of training in road traffic laws, or without a license or certificate to operate such specialized vehicles.

  10. Assigning motor vehicles or specialized vehicles to persons who are not qualified to operate them in road traffic.

  11. Operating motor vehicles at excessive speeds, aggressively seizing lanes, or overtaking recklessly.

  12. Continuously honking or revving engines; honking between 10:00 p.m. and 5:00 a.m.; honking air horns; using high beams in urban areas or densely populated areas, except for priority vehicles performing duties as prescribed by this Law.

  13. Installing or using horns and lights not in accordance with the manufacturer’s design for each type of motor vehicle; using audio devices causing disorder to traffic safety and public order.

  14. Transporting prohibited goods; illegally transporting or failing to comply with regulations on transporting hazardous goods or wildlife.

  15. Threatening, insulting, scrambling for, or soliciting passengers; coercing passengers to use services against their will; transferring passengers or dropping them off, or committing other acts to evade detection of overloaded vehicles or vehicles carrying more passengers than permitted.

  16. Conducting automobile transport business without meeting the statutory business conditions.

  17. Absconding after causing an accident to evade responsibility.

  18. Failing to render aid to victims of traffic accidents despite having the ability to do so.

  19. Infringing upon the life, health, or property of accident victims or persons causing accidents.

  20. Taking advantage of traffic accidents to assault, threaten, incite, exert pressure, disrupt order, or obstruct the handling of traffic accidents.

  21. Abusing one’s position, authority, or profession, or that of others, to commit violations of road traffic laws.

  22. Illegally manufacturing, using, buying, or selling license plates of motor vehicles or specialized vehicles.

  23. Committing violations of road traffic rules or other acts endangering persons and vehicles participating in road traffic.

  • The examination of blood alcohol concentration under this Clause is guided by Joint Circular No. 26/2014/TTLT-BYT-BCA, effective as of September 19, 2014.
