
Important Terms in the Law on Housing

Housing means a construction built for the purpose of residence and to meet the living needs of families and individuals. Housing used for residential purposes and other purposes not prohibited by law is considered mixed-use housing.

Detached housing means housing built on a separate residential land parcel under the land use rights of an organization or individual, or on leased or borrowed land of an organization or individual, including villas, adjoining houses, and independent houses, built for residential purposes or mixed-use purposes.

Apartment building (condominium) means housing of two or more stories, having multiple apartments, common passages and stairways, private ownership parts, common ownership parts, and a system of shared infrastructure facilities for families, individuals, and organizations, including condominiums built for residential purposes and condominiums built for mixed-use purposes.

Commercial housing means housing invested in and constructed for sale, hire-purchase, or lease in accordance with market mechanisms.

Official-duty housing means housing arranged for persons entitled to official-duty housing to rent during the period they hold positions or perform duties in accordance with this Law.

Resettlement housing means housing arranged for persons entitled to resettlement when the State recovers residential land and clears housing in accordance with law.

Social housing means housing supported by the State for persons eligible for housing assistance policies.

Worker dormitory in an industrial zone means a construction built on commercial or service land within an industrial zone, in accordance with the law on management of industrial zones, to provide accommodation for workers during their working period in that industrial zone.

Housing for the people’s armed forces means social housing for sale, hire-purchase, or lease to eligible persons in the people’s armed forces.

Old housing means housing built before 1994, including apartment buildings.

Housing under public property means housing owned by the entire people, with the State acting as the representative of the owner and exercising unified management.

Housing construction investment project means a collection of proposals related to the use of capital to carry out new construction, reconstruction, renovation, or repair of housing, technical infrastructure, and social infrastructure works serving residential needs at a specific location within a defined duration and budget.

Domestic organizations include state agencies, units of the people’s armed forces, public non-business units, political organizations, socio-political organizations, socio-political-professional organizations, social organizations, socio-professional organizations, economic organizations, and other organizations as prescribed by civil law (hereinafter collectively referred to as “organizations”).

Investor of a housing construction investment project means an organization selected to implement a housing construction investment project.

Housing development means investment in new construction, reconstruction, or renovation of housing to increase housing area.

Housing renovation means upgrading quality, increasing area, or adjusting the structure of the area of existing housing.

Housing maintenance means periodic upkeep, maintenance, and repair of housing upon damage, in order to maintain quality, normal operation, and safety of housing during its exploitation and use.

Owner of housing means an organization or individual having ownership rights over housing.

Owner of an apartment building means the owner of an apartment unit or the owner of another non-apartment area in the apartment building.

Private ownership part in an apartment building means the area in an apartment unit or in another non-apartment area in the apartment building recognized as private ownership of the apartment owner, and equipment used exclusively within that apartment or non-apartment area of the apartment owner.

Common ownership part of an apartment building means the remaining area of the apartment building, other than the areas under private ownership of apartment owners, and the equipment used in common for that apartment building.

Hire-purchase of housing means that the hire-purchaser makes an upfront payment to the hire-purchase lessor for a certain percentage of the housing value as agreed, but not exceeding 50% of the value of the hire-purchase contract; the remaining amount is converted into monthly rental payments to the hire-purchase lessor for a specific period as agreed; after the hire-purchase period ends and the remaining amount is fully paid, the hire-purchaser acquires ownership of the housing.

Available housing means housing that has been completed and accepted for use in accordance with the law on construction.

Housing to be formed in the future means housing under investment and construction, or housing not yet accepted for use in accordance with the law on construction.
