Prohibited Acts under the Law on Housing

  1. Infringing upon the housing ownership rights of organizations and individuals.

  2. Obstructing the performance of state management responsibilities in housing, or obstructing the exercise of rights and obligations relating to the ownership, use, and transactions of housing by organizations and individuals.

  3. Deciding on or approving investment policies or approving housing construction investment projects that are inconsistent with approved land use planning, construction planning, urban planning, or housing development programs and plans.

  4. Constructing housing on land not designated for housing construction under this Law; constructing or renovating housing inconsistent with land use planning, construction planning, or urban planning; failing to comply with applicable design standards or minimum area standards for each type of housing where such standards are required by competent state agencies; misapplying the method of calculating housing usable area prescribed in this Law; unlawfully developing multi-story, multi-apartment housing by individuals.

  5. Illegally occupying housing area; encroaching on common ownership areas or the property of other owners in any form; renovating, expanding, demolishing, or reconstructing housing under lease, hire-purchase, borrowing, lodging, or authorized management without the consent of the owner.

  6. Entering into fundraising documents or mobilizing capital for housing development without meeting the conditions prescribed by this Law and other relevant laws; misusing mobilized funds or advance housing payments for housing development.

  7. Conducting housing transactions (sale, hire-purchase, lease, lodging lease, donation, exchange, mortgage, capital contribution, lending, lodging, or authorization of management) contrary to the provisions of this Law and other relevant laws; handing over housing to buyers or hire-purchasers without meeting the conditions prescribed by this Law and the law on construction.

  8. Prohibited acts in the management and use of apartment buildings include:
    a) Failing to pay maintenance funds for common ownership parts of apartment buildings (hereinafter referred to as maintenance funds); mismanaging or misusing operation management funds or maintenance funds contrary to the provisions of housing law;
    b) Intentionally causing leakage or seepage; creating excessive noise or vibration; discharging waste, wastewater, exhaust gases, or hazardous substances contrary to environmental protection law or internal regulations on the management and use of apartment buildings; painting or decorating the exterior of apartments or apartment buildings contrary to design or architectural regulations; raising or grazing livestock or poultry; slaughtering livestock within the apartment building premises;
    c) Arbitrarily converting functions or purposes of common ownership or common-use areas of apartment buildings; using apartments for non-residential purposes; altering or damaging load-bearing structures; subdividing or combining apartments without permission from competent state agencies;
    d) Arbitrarily using common ownership areas and equipment for private purposes; changing the use purpose of service areas in mixed-use apartment buildings without permission from competent state agencies to change the use purpose;
    đ) Causing disorder, insecurity, fire, or explosion in apartment buildings; trading in flammable or explosive materials, or conducting trades and occupations that endanger the lives and property of apartment building occupants contrary to the law on fire prevention and fighting and other relevant laws;
    e) Operating nightclubs, karaoke bars, or bars; operating motor vehicle repair businesses; conducting other polluting service businesses contrary to environmental protection law; operating restaurants without complying with requirements on fire prevention and fighting, escape routes, and other business conditions as prescribed by law.

  9. Using detached housing for trading flammable or explosive materials, conducting polluting service businesses, or creating noise, or otherwise affecting public order, social safety, or the living environment of residential communities without complying with business condition requirements under law.
