Article 318 of the 2015 Criminal Code – Offence of Disturbing Public Order
1. Any person who disturbs public order, causing adverse effects on security, order, or social safety, or who has already been administratively sanctioned for this act, or has been convicted of this offence and has not yet had the criminal record expunged but continues to commit the violation, shall be subject to a fine of between VND 5,000,000 and VND 50,000,000, non-custodial reform for up to 02 years, or imprisonment for a term of between 03 months and 02 years.
2. If the offence falls under any of the following circumstances, the offender shall be liable to imprisonment for a term of between 02 years and 07 years:
a) The offence is committed in an organized manner;
b) Weapons, dangerous instruments are used, or acts of vandalism are committed;
c) The act seriously obstructs traffic or disrupts public activities;
d) The offender incites others to cause disorder;
dd) The offender assaults a person who intervenes to maintain public order;
e) The offence is committed in a case of dangerous recidivism.
