The Act of Insulting a Person’s Honor and Dignity under the Offence of Humiliating Another Person
1. Any person who seriously infringes upon the honor or dignity of another person shall be subject to a warning, a fine of between VND 10,000,000 and VND 30,000,000, or non-custodial reform for up to 03 years.
2. If the offence falls under any of the following circumstances, the offender shall be liable to imprisonment for a term of between 03 months and 02 years:
a) The offence is committed two or more times;
b) The offence is committed against two or more persons;
c) The offender abuses their position or power;
d) The offence is committed against a person performing official duties;
dd) The offence is committed against a person who teaches, nurtures, cares for, or provides medical treatment to the offender;
e) The offender uses a computer network, telecommunications network, or electronic device to commit the offence;
g) The act causes mental and behavioral disorders to the victim at a rate of between 11% and 45%.
3. If the offence falls under any of the following circumstances, the offender shall be liable to imprisonment for a term of between 02 years and 05 years:
a) The act causes mental and behavioral disorders to the victim at a rate of 46% or more;
b) The act drives the victim to commit suicide.
4. The offender may also be prohibited from holding certain positions, practicing certain professions, or performing certain jobs for a period of between 01 year and 05 years.
